Route 1 Burgers and Doner Kebab, located at 236 Balgores Lane in Gidea Park, has been ordered by Havering Council to cease takeaway and delivery services due to planning violations.
The council issued an enforcement notice after determining that the business changed its use without permission. Previously classified under class E—which covers restaurants, shops, and gyms—the premises shifted to a mixed use as a café/hot food takeaway. Takeaways fall under a different planning category called sui generis, requiring separate approval.
The notice also cites the unauthorized installation of an extractor flue at the rear of the building. This has reportedly caused higher levels of noise, vibration, and odors, negatively affecting nearby residents.
The council stated the flue’s impact is “unacceptable” and highlighted concerns that the takeaway’s proximity to a school does not promote “healthy lifestyles” for children.
Afzol Siddique, the restaurant manager, expressed that he feels the council’s treatment is unfair and announced plans to appeal the enforcement notice.
The kebab shop must halt takeaway services and remove an extractor flue due to planning breaches and resident complaints but plans to challenge the decision.
